Terms & Conditions of Sale, Supply, and Service

Please read these Terms and Conditions carefully before using this website or purchasing products and services. By placing an order, you agree to be bound by this agreement.

1. Parties and Scope of Trade

  • The Business: This website is operated by an Authorised Reseller of Easigas (Pty) Ltd.
  • Territory: Orders, deliveries, and services are strictly restricted to designated municipal zones within South Africa. No international orders or cross-border transport will be fulfilled.

2. Regulated Pricing Compliance

  • Maximum Retail Price: LPG retail prices are strictly regulated by the South African Department of Mineral Resources and Energy (DMRE).
  • Price Adjustments: Prices published on this website are subject to monthly statutory changes. The final price charged will mirror the legal rate at the time of order confirmation. We will never exceed the gazetted Maximum Retail Price (MRP).

3. Cylinder Ownership and Exchange Policy

  • Ownership: Physical gas cylinders remain the sole property of Easigas (Pty) Ltd or its approved brand network. The customer purchases the gas content, not the physical container.
  • Deposit System: New users without an empty cylinder must pay a mandatory cylinder cross-deposit fee. This deposit is subject to Easigas network refund policies.
  • Exchange Conditions: We operate on a strict "one-for-one" exchange system. We will only accept an empty cylinder that is: an authentic, legal Easigas cylinder (or approved network brand); structurally sound, unmodified, and clean; and free from illegal third-party refilling modifications or non-standard valves.
  • Right of Refusal: We reserve the absolute right to reject any cylinder that fails to meet these criteria. If rejected, the customer must pay the standard cylinder deposit before a full cylinder is issued.

4. Safe Delivery and Transport (SANS 10087 Compliance)

  • Regulatory Framework: All transportation, handling, and dropping off of LPG comply with South African National Standard SANS 10087 and local Hazchem zoning laws.
  • Access Requirements: Deliveries will only be completed if the drop-off location provides a safe, unobstructed environment that complies with municipal fire safety bylaws.
  • Click-and-Collect: If choosing a collection option, customers must transport cylinders in accordance with legal safety limits (e.g., upright, secured, and within local payload limits). We reserve the right to withhold stock if a customer's transport setup is deemed hazardous.

5. Gas Installation Services and Certificates (CoC)

  • Certified Technicians: Any connection, maintenance, or installation service offered through this website is executed by technicians legally registered with SAQCC Gas under the Occupational Health and Safety (OHS) Act.
  • Certificates of Compliance (CoC): A CoC will only be issued if the customer's entire gas line system and connected appliances fully satisfy SANS regulations.
  • Refusal of Service: Technicians will refuse to connect a cylinder to an appliance or system that is corroded, outdated, or structurally illegal. The customer remains liable for the call-out fee in these instances.

6. Limitation of Liability and Customer Indemnity

  • Transfer of Risk: Risk of loss, damage, or injury passes entirely to the customer immediately upon physical delivery or collection of the cylinder.
  • Exclusion of Liability: To the maximum extent permitted under the Consumer Protection Act (CPA), the Business, its employees, and Easigas shall not be held liable for any direct, indirect, incidental, or consequential damage, property loss, injury, or death resulting from: incorrect connection, storage, or positioning of cylinders by the customer; negligent operation of gas appliances; unauthorised third-party refilling or tampering with valves and safety seals; or pre-existing structural faults in the customer's property gas lines.

7. Statutory Consumer Rights (CPA & ECTA)

  • Cooling-Off Period: In terms of Section 44 of the Electronic Communications and Transactions Act (ECTA), customers enjoy a 7-day cooling-off period. However, this excludes gas cylinders once the tamper-evident safety seal has been broken or compromised.
  • Defective Goods: Defective valves or faulty cylinders will be handled, replaced, or refunded strictly in accordance with Section 56 of the Consumer Protection Act (CPA).
